1. Introduction

Welcome to Lootex Marketplace V3, a digital platform designed for trading and showcasing Non-Fungible Tokens (NFTs) ("Lootex," "we," "us," or "our"). These Terms of Use (the "Terms") govern your access to and use of the Lootex website located at https://lootex.io/ (the "Site"), the Lootex platform, and any associated services provided by Lootex (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.

 

2. Eligibility

To access and use the Services, you must be at least 18 years of age or the age of legal majority in your jurisdiction (whichever is greater). By accessing or using the Services, you represent and warrant that you meet these eligibility requirements.

 

3. Account Registration

4. NFTs and Transactions

Lootex is a marketplace for trading NFTs related to gaming. Users can create, buy, sell, trade, and showcase their NFTs on Lootex. All transactions, including sales, purchases, and trades, are facilitated by smart contracts on the Ethereum or other blockchain. By using the Services, you acknowledge and agree that Lootex does not hold or control your NFTs and is not responsible for any transactions or disputes between users.

 

5. Fees

Lootex charges fees for certain transactions, such as listing, buying, or selling NFTs. By using the Services, you agree to pay any applicable fees. Lootex reserves the right to change its fee structure at any time and will provide notice of any changes on the Site.

 

6. Content and Intellectual Property

Lootex does not claim ownership of any content you submit, post, or display on the Services, including NFTs. However, by submitting, posting, or displaying content on the Services, you grant Lootex a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform the content in connection with the Services.

 

7. Prohibited Activities

You agree not to engage in any prohibited activities when using the Services, including, but not limited to:

Creating, uploading, or sharing content that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or that encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate.
  2. Infringing on the intellectual property rights of others, including copyrights, trademarks, trade secrets, patents, or any other proprietary rights.
  3. Using the Services for any illegal activities, such as money laundering, terrorism financing, or the purchase or sale of illegal goods or services.
  4. Manipulating or exploiting the Services, including using bots, scripts, or other automated methods to create, buy, sell, or trade NFTs, or to artificially inflate or manipulate the value or perceived value of NFTs.
  5. Engaging in any fraudulent activities, such as impersonating another person or entity, providing false or misleading information, or using stolen or unauthorized payment methods.
  6. Interfering with, disrupting, or compromising the security or integrity of the Services, the Site, or any associated servers, networks, or systems.
  7. Harvesting or collecting personal information about other users, including email addresses or other contact information, without their consent.
  8. Creating multiple Accounts or using any means to circumvent any limitations or restrictions placed on the use of the Services.
  9. Assisting or encouraging any third party in engaging in any of the activities described above.

 

By using the Services, you agree to comply with all applicable laws, rules, and regulations and to refrain from engaging in any of the prohibited activities listed above. Lootex reserves the right to investigate, suspend, or terminate your access to the Services if we believe, in our sole discretion, that you have engaged in any prohibited activities.

 

8. Termination

Lootex reserves the right to suspend or terminate your access to the Services, without notice or liability, for any reason, including if you breach these Terms.

 

9. Disclaimers and Limitation of Liability

Lootex provides the Services on an "as is" and "as available" basis, without any warranties of any kind. Lootex disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Lootex's total liability for any claim arising out of or relating to these Terms or the Services will not exceed the amount paid by you for the Services in the six months preceding the date on which the claim arose.

 

10. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or relating to these Terms or the Services will be governed by and construed in accordance with the laws of the jurisdiction in which Lootex is incorporated, without regard to its conflict of law provisions. You and Lootex agree to submit to the exclusive jurisdiction of the courts located within that jurisdiction for the purpose of resolving any disputes arising out of or relating to these Terms or the Services.

 

11. Changes to the Terms

Lootex reserves the right to modify these Terms at any time. If we make material changes to these Terms, we will notify you by posting the updated Terms on the Site or through other appropriate means. By continuing to access or use the Services after the updated Terms become effective, you agree to be bound by the updated Terms.

 

12. Miscellaneous

These Terms constitute the entire agreement between you and Lootex concerning your access to and use of the Services and supersede all prior or contemporaneous agreements, representations, warranties, and understandings. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. No waiver of any provision of these Terms will be deemed a further or continuing waiver of such provision or any other provision.
